Bayelsa: Judgment review appeal lacks merit – Supreme Court

The application of the All Progressive Congress (APC) seeking review of the judgment of the Supreme Court on Bayelsa State governorship election has been dismissed.

The apex court had sacked the candidate of the APC, David Lyon, over discrepancies in educational qualifications submitted by his deputy, Biobarakuma Degi-Eremienyo.

In dismissing the application on Wednesday, the apex court held that it lacked merits.

“There must be an end to litigation even if we review this judgment, every disaffected litigant will bring similar applications and the finality of Supreme Court judgments will be lost,” Justice Amina Augie who chairs the panel that dismissed the application said.

The judge added that the applications are frivolous and vexatious, and awarded the cost of N10 million against the applicants to be personally paid by their counsel.

The People Democratic Party (PDP) benefitted from the verdict of the Supreme Court when it was delivered.

Its candidate, Duoye Diri, has since been sworn-in as governor of the oil rich state.
